Here’s the scoop for the week

“Keep Kids Fed Act” Signed into Law by President Biden on June 27, 2022

This action extends summer meal waivers which means all students will be able to receive free meals this summer. In addition, the federal reimbursement rate for school lunch was increased by 40 cents and breakfasts by 15 cents for the school year beginning July 2022. The legislation does not include universal free meals and families who are eligible for free and reduced lunch will need to complete paperwork as in the past.

U.S. Supreme Court Rulings with E-12 Implications

  • The Court ruled a football coach in the state of Washington who prayed on the 50-yard line with players was within his rights. The coach had repeatedly defied school district directives to stop the practice claiming he had the right to exercise his religious beliefs. The Supreme Court sided with him. Stay tuned for how this might affect similar situations in our public schools.
  • The Court ruled it was unconstitutional for a Maine voucher program to not allow public funds to go to schools that promoted religious instruction. The ruling does not require states to fund private schools if they are not already doing so, but in the case of Maine that was providing funds to private schools, it cannot exclude funds from private religious schools.

Title IX Proposed Changes:

Here is information from the U.S. Department of Education on recently released changes proposed to Title IX, and the link where this information may be found:

The proposed regulations would:

  • Clearly protect students and employees from all forms of sex discrimination.
  • Provide full protection from sex-based harassment.
  • Protect the right of parents and guardians to support their elementary and secondary school children.
  • Require schools to take prompt and effective action to end any sex discrimination in their education programs or activities – and to prevent its recurrence and remedy its effects.
  • Protect students and employees who are pregnant or have pregnancy-related conditions.
  • Require schools to respond promptly to all complaints of sex discrimination with a fair and reliable process that includes trained, unbiased decisionmakers to evaluate the evidence.
  • Require schools to provide supportive measures to students and employees affected by conduct that may constitute sex discrimination, including students who have brought complaints or been accused of sex-based harassment.
  • Protect LGBTQI+ students from discrimination based on sexual orientation, gender identity, and sex characteristics.
  • Clarify and confirm protection from retaliation for students, employees, and others who exercise their Title IX rights.
  • Improve the adaptability of the regulations' grievance procedure requirements so that all recipients can implement Title IX's promise of nondiscrimination fully and fairly in their educational environments.
  • Ensure that schools share their nondiscrimination policies with all students, employees, and other participants in their education programs or activities.

MDE Response to Letter Circulating Regarding Ed-Fi

Roughly 70 school districts signed a letter sent to MDE requesting input on the implementation of Ed-Fi and for a delay in implementation. Here is MDE’s response to the letter.

  1. GFW Superintendent Jeff Horton from GFW was selected as one of the 2021 National School Public Relations Association’s “Superintendents to Watch.”
  2. Alexandria Superintendent Rick Sansted was selected for the Education Policy Fellowship Program.

Are you Considering Retiring and Returning to work as an Interim?

Recent legislation passed and signed into law by Governor Walz on May 22, 2022, might have implications for you if you want to accept an interim position following retirement. The new legislation suspends the TRA earnings limitation for the next three fiscal years-2022, 2023, and 2024. In other words, you may be able to earn a full salary from a school district and collect your TRA and/or SPTRFA at the same time during the years specified when the earnings limitation is suspended.

As always, it is important that you first contact TRA and/or SPTRFA for more information about your particular situation before you make decisions about retiring and accepting an interim position.

The text of the bill that applies follows:

SUSPENSION OF EARNINGS LIMITATIONS FOR RETIRED TEACHERS WHO RETURN TO WORK.

Subdivision 1. 

Reemployed teacher defined. 

For the purposes of this section, "reemployed teacher" means a person who retires under the provisions of Minnesota Statutes, chapter 354 or 354A, and who subsequently resumes teaching for a public school of the state, a charter school, or the Perpich Center for Arts Education. Reemployed teacher does not include a person who resumes teaching for a postsecondary institution, including a state college or university.

Subd. 2. 

Three-year suspension of earnings limitation for teachers covered by TRA and SPTRFA. 

(a) Notwithstanding Minnesota Statutes, section 354.44, subdivision 5, no portion of a reemployed teacher's annuity paid under Minnesota Statutes, chapter 354, shall be deferred regardless of the amount of the salary earned from the teaching service during the preceding fiscal year. This paragraph applies only to salary earned during fiscal years 2022, 2023, and 2024 and annuity payments made during calendar years 2023, 2024, and 2025.

(b) Notwithstanding Minnesota Statutes, section 354A.31, subdivision 3, no portion of a reemployed teacher's annuity paid under Minnesota Statutes, chapter 354A, shall be deferred or forfeited regardless of the amount of the salary earned from the teaching service during the preceding calendar year. This subdivision applies only to salary earned during calendar years 2022, 2023, and 2024 and annuity payments made during calendar years 2023, 2024, and 2025.

Subd. 3. 

Expiration date. 

This section expires effective January 1, 2026.

EFFECTIVE DATE. 

This section is effective the day following final enactment.

Letter Circulating Regarding Ed-Fi and Request to MDE to Reassess the Transition Plan:

A number of superintendents have been asked to sign this letter to MDE regarding Ed-Fi for Education Reporting. Please note that MDE has already received the letter and is considering a response. At the last report about 70 school districts had signed the letter prior to its submission to MDE.

Will there be a Provisional Online Learning Application and Approval Process for 2022-2023?

MDE staff shared on June 15 that only those school districts fully approved as an Online Learning Provider will be able to provide online learning during the upcoming school year. So the answer to the question is “no.”

Just a quick refresher that Online Learning should not be confused with E-Learning Days or Distance Learning. Five E-Learning Days are available in a school year for the purpose of inclement weather, and Distance Learning was instituted in March of 2020 when all school districts were mandated by the Governor’s Executive Order to move to virtual learning. Online Learning requires the successful approval of an application submitted by school districts interested in offering the program.

Interested in Early Childhood Learning and Data Collection?

MASA needs a representative on MDE’s Early Childhood Longitudinal Data System, ECLDS, Governing Board. Superintendent Darren Kermes has served on the board for a number of years, and given the meeting schedule, he is no longer available as MASA’s representative on the board. We are grateful to Superintendent Kermes for his years of service on the ECLDS Board!

Clearly, there is a pattern in both the metro and greater MN that is causing a great deal of justifiable frustration, and that is resulting in increased competition between school districts to hire and retain staff. 

If you have suggestions for how we can solve the staffing shortages,  please don’t hesitate to contact me. I know of other members willing to come together to find meaningful solutions. 

Which Successes are MASA Members Finding Most Wonderful to Celebrate?

Most of our members will attend one or two (or more) graduations this time of year, and many of our members will have the honor of handing their graduates their diplomas. It is wonderful to see graduates launched into all of the possibilities of their futures and know that the wisdom, skill, commitment, and resilience of our educators had a significant role in getting them there. Congratulations to our graduates, and to our members for the success of the Class of 2022!

Will the Governor Call a Special Session?

We certainly hope so, but as of this writing, there is no news to share. Please continue your advocacy efforts. Governor Walz, Speaker Hortman and Majority Leader Miller need to hear they have unfinished business to complete.

Here is an outstanding letter written by MASA Region 2 Superintendents to legislators should you wish to replicate their efforts. They did receive a response from Speaker Hortman. A huge thanks to Superintendent Mandy Fletcher for leading this effort!
